Need, no; it would be enough if the potential adopters gave a reflexive
thumbs-down on anything that has patent issues.  IETF standardization
of something means absolutely nothing if nobody adopts the standard.

Maybe.  We can't tell until the patent is issued, because until then
nobody knows how broad a brush it paints with.
